Terms and Conditions

Object of the contract and its definition The term "sales contract" refers to a contract concluded at a distance between the Supplier, Silwart di Silvia Maria Gustinetti (hereinafter referred to as "Silwart"), located at Via Monte Aga n. 41 - 24068 Seriate (BG), VAT 04621040163, and a person (hereinafter referred to as "Customer"), within a sales system organized by the Supplier which, for this contract, employs an online shop based on the remote communication technology called "internet".

Customer refers to the natural person who purchases the goods subject to the sale, as shown on this website www.Silwart.it owned by Silwart di Silvia Maria Gustinetti.

Prices, conditions, and availability of products may be subject to change without notice.

Each Customer is invited to read the contract before completing a purchase order.

The general sales conditions applicable are those present at the time of order formalization.

The sending of an order by the Customer implies acceptance of the general sales conditions present on the site at that time.

Purchase Methods The purchase order must be formalized by the Customer by filling out the order form present on the online shop, specifying the item they wish to purchase and the details related to its creation, such as color choice and any customizations, according to the options made available by the Supplier.

The order form requires the completion of certain details relating to the Customer, such as name, surname, email address, date of birth, tax code, mobile phone number, billing address, and shipping address.

The Customer is required to carefully check the details contained in the order before sending it to the Supplier.

Receipt of the order will be confirmed via email by the Supplier, who will forward the order confirmation to the Customer, specifying all the necessary details to proceed with the creation of the product, the total amount to be paid, including shipping costs, the estimated preparation time for the product, and any additional information if necessary.

If clarifications are needed, the Customer can contact the Supplier before formalizing the order. It will still be the Supplier's responsibility to check the completeness of the order to proceed correctly with the creation of the item ordered by the Customer.

The Customer is obliged to immediately inform Silwart via email at info@silwart.it if they do not receive the order confirmation within 48 working hours from the contract date (order sending date).

If an item displayed on this site cannot be provided or is not available at that particular time for any reason, Silwart undertakes to promptly notify the Customer upon receipt of the purchase order and to propose, where possible, a similar alternative in type and value. If the Customer decides to cancel the order, the amount paid will be fully refunded.

All notifications related to the purchase procedure described above will be sent to the email address provided by the Customer for this purpose.

Payments Payment for purchased products and related extra costs (courier, any customizations, special requests) is required at the time of purchase and must be made by the Customer through the available online payment channels or by advance bank transfer. The bank details (IBAN) for executing the bank transfer will be communicated in the order confirmation email.

The advance bank transfer payment must indicate as the reason the order reference assigned by Silwart at the time of order confirmation and the Customer's name. The Customer is also required to send a payment notification email to info@silwart.it, specifying the order reference and attaching the payment receipt.

Payments that incur collection fees for Silwart will not be accepted.

The creation of the product will begin once the payment has been received. It is reminded that Silwart creations are made to specific order to satisfy the choice of color, fabrics, details, and customizations requested by the Customer.

The order will be shipped as soon as the ordered product is ready, according to the preparation forecast indicated in the order confirmation.

It is reminded to the Customer that all Silwart products are handmade; therefore, the realization time can vary from fifteen (15) to twenty (20) days. Courier shipping times are to be added (estimated 24/72 hours).

The sales invoice or receipt will be placed inside the shipping package.

Prices The purchase of products is made by the Customer at the price indicated on the site at the time of order submission.

All sale prices are expressed in Euros and inclusive of VAT for the recipient countries, where applicable.

Extra costs related to any customizations are excluded, which will be calculated separately and displayed by the Supplier to the Customer before the order confirmation and included in the same upon Customer's acceptance. In case of customizations, the Customer is requested to contact the Supplier in advance to verify feasibility and be informed of any extra cost.

Shipping costs are excluded, which will be calculated and shown separately at the order completion stage.

Any duties and import taxes for Customers residing in non-EU countries are excluded. These costs will be entirely borne by the Customer.

Responsibility The images and colors of the products offered for sale are true to the real colors of the products shown on the website www.silwart.it. However, these colors may not perfectly match the real ones due to the Internet browser and/or monitor used.

Moreover, the proposed colors may undergo slight shade variations depending on the dye used by the tannery and/or the textile company supplying the raw material that Silwart uses to create its products. In such cases, Silwart cannot be held responsible for variations beyond its control. Silwart nonetheless guarantees careful quality control of the incoming raw material to ensure that any variations are minimal and therefore negligible.

The Supplier is not responsible in any case for injuries or accidents caused by the use of the goods on sale.

Do not allow children under the age of three to use the purchased products without adult supervision, due to the danger of swallowing some small parts, if present.

Customer Obligations The customer must be of legal age. To place an order, the Customer must provide the following data: name, surname, email address, date of birth, tax code, mobile phone number, billing address, shipping address.

The Customer undertakes, once the purchase procedure is concluded, to print and keep these general sales conditions, which, moreover, they will have already viewed and accepted by confirming the purchase order.

It is strictly forbidden for the purchaser to enter false, invented, third-party, or fictional data in the registration procedure necessary for executing this contract. The personal and email data must be exclusively their real personal data. If the provided data is false, Silwart has the right to withdraw from the contract even if it has already been concluded. The withdrawal from the contract will be communicated via PEC to the email address provided by the Customer during registration.

The purchase of products for resale purposes is absolutely prohibited.
